Analysis of Bottleneck power effects in Digital Platform Markets: Causes, implications and possible solutions

Este artigo tem como objetivo avaliar os efeitos do poder de gargalo (Bottleneck Power) em mercados de plataformas digitais. Discutem-se as causas e implicações deste poder no mercado digital e quais as possíveis soluções para que as condições de acesso ao mercado permaneçam competitivas. Em especial, procura-se compreender a importância de uma associação entre a regulação e o antitruste para evitar condutas exclusionárias em mercados de plataformas digitais. Para exemplificar os efeitos do comportamento bottleneck power, analisou-se a conduta das Plataformas marketplaces do Google e Apple. Como observado em diferentes relatórios dos órgãos de defesa da concorrência, a criação de um regulador específico de plataformas digitais que atuem em conjunto com a entidade antitruste é um processo necessário para assegurar a concorrência e controlar os efeitos de bottleneck power.

This paper aims to evaluate the effects of Bottleneck Power in digital platform markets. The causes and implications of this power in digital marketplaces are discussed, and what are the possible solutions for market access conditions to remain competitive. In particular, it seeks to understand the importance of an association between regulation and antitrust to prevent exclusionary conduct in digital platform markets. To exemplify the effects of bottleneck power behavior, the conduct of Google and Apple marketplaces was analyzed. As observed in different reports by antitrust agencies, the creation of a specific regulator of digital platforms that acts together with the antitrust entity is a necessary process to ensure competition and control the bottleneck power effect.
